Custody and divorce is a stressful, time consuming and often an expensive process.  However, for parents that are willing to work together towards solutions, mediation offers a collaborative and trust building process meant to build solutions towards a new co-parenting dynamic.  Mediation allows the parents to craft out-of-the-box solutions and have better control in the outcome of their case, all while reducing the legal costs.

Nichol Fitzpatrick is trained in family law mediation to find personalized solutions unique for your specific family and brings the experience to help the parties move forward.  She genuinely cares about the wellbeing of your children and wants your children to have good parenting relationships while also promoting good co-parenting.

Interested in talking to the other parent about mediation?  Here's are some facts that may help you before scheduling a joint consultation with our office:

  • Mediation is a joint decision.  The mediation participation agreement is signed by both parents agreeing to work collaboratively towards a solution and sharing in its costs. 

  • Our approach is that children deserve (and barring a significant parenting fitness issue) should have both parents who are active and engaged in their lives.  

  • Our role is to be neutral and jointly retained by both parties for mediation.  

  • Nichol has a wealth of experience working in family law over many years, with significant trial experience.  While she continues to act in a neutral capacity, the role of mediation allows for advisement mediation to help the parties understand trial risks.  

  • As part of our intake process, we will have a joint video call with both parents to discuss the issues and what agreements, if any, have been discussed as well as how you both envision the cost sharing for mediation, or if one parent is paying the full amount.

  • Once onboard, we will then hold individual calls to understand your concerns and work with both parents to collect documents that will be helpful to our mediation day and we will schedule a date for all three of us to meet in person to mediate the issues.  All mediations are scheduled for a full-day, starting at 9:00 a.m. 

  • Custody and divorce litigation can end up costing $7,000 - $20,000 per side, depending on the complexity of the issues and the litigiousness of the parties.  With mediation, we substantially reduce your risk of trial while also focusing in on a personalized approach.  Our mediation clients will typically spend $2,500 on the mediation day and may have some ancillary costs related to mediation prep work and finalizing the written agreement.
